MEDIATION

Mediation is a confidential and cost-effective way to resolve disputes of all kinds. OptionBridge mediators can assist you identify key issues, get concerns out in the open and on the table, and develop options that work and make sense for all.

ARBITRATION

Arbitration is a private form of trial but with a person chosen by the parties to make the decision. Whether the dispute is heard by a single arbitrator or a panel selected by the parties or appointed under a contract, the arbitration hearing is private. As in a trial, each side presents its best case, and the arbitrator applies the law to the facts and renders a decision. The decision is typically final, unless the parties agree otherwise, which eliminates the delays and costs associated with an appeal, unlike litigation. Parties may choose to be represented by counsel and may also present expert testimony. Arbitration offers a decision based on the facts and the law without the expense and delay of court proceedings.

NEUTRAL EVALUATION (OR CASE EVALUATION)

When a neutral, realistic assessment of the value or potential outcome of a disputed issue is needed because the parties can’t agree or need to convince others, an evaluator can provide an objective evaluation of a dispute. An evaluator who possesses substantive expertise may provide an assessment of the merits of the case and/or the strengths and weaknesses of each party’s position. Provision of an objective assessment of the case generally assists in making further negotiations more productive and effective.

NEUTRAL FACT-FINDING

To resolve disagreements about facts, the parties in a dispute can utilize the services of an impartial third person to decide the factual issues in dispute. Bringing in someone who is objective with no stake in the outcome to serve as a neutral fact-finder can help remove obstacles to agreement.
